1. Agreement

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer. All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.The Seller may choose not to accept an order for any reason. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions. 

2. Order

The information given by the Buyer at the time of order shall be deemed legally binding. In the case of misleading or mistaken information as to the Buyer's details, the Seller shall not be liable for failed delivery. Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller. Payment of the total purchase price (including VAT and any delivery charges) must be made in full before dispatch of the Goods. The Zampower company shall fullfil orders placed via the Internet within the limits of available stocks. In case of goods out of stock, the Buyer shall notify the Seller promptly. The photos of the website are not legally binding.

3 Deliveries

For deliveries within Metropolitan France, the average time of delivery is 48 hours ( working days ), from the day of receipt of the order before 12 noon, subject to product availability. An order placed on Friday pm will be dispatched on Monday am.

For deliveries outside Metropolitan France, the average delivery time is 10 days ( working days ), from the day of receipt of the order before 12 noon, subject to product availability.

These delays will be respected bar force majeure. Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

Deliveries shall be made via postal services. The Seller shall not be held liable for dysfunctions arising from the services of La Poste. Shipping charges are set at 12€ for Metropolitan France. In the case of mistakes in the country of delivery, ZamPower reserves the right to charge additional shipping costs or to cancel the order. 

4. Customs duties

Orders placed via the Internet and delivered outside Metropolitan France may be liable to taxes and customs duties at the place of delivery. The Buyer shall be liable for all such taxes, whether Seller invoiced Buyer  for them. The Buyer is not responsible for informing Seller of applicable taxes and duties. We advise Buyer to seek proper information by the relevant autorities.

5. Reception.

Claims regarding products must be filed within two days of reception of delivery.

6. Cancellation and returns 

Broken or defective items. Although we take the utmost care in the selection and the packing of our products, we are not totally immune to mistakes or incidents. In that case, you have eight days to report the incident at 03 88 45 88 86 or by mail at contact@zampower.com.

7. Prices

All prices are in euro all taxes incluced. They include the VAT charge at the day of the order. Any change in VAT rate will be applied to the price list.

8. Promotional offers

Our promotionnal offers are valid within the available stocks.

9. Payment

Payment is expected at the date of the order. Online payment is made via credit card ( Visa, Eurocard, Mastercard ) or by cheque to the order of Boulevard des Productions, to be sent at

Boulevard des Productions ZAMPOWER, 2 chemin Goeb 67000 Strasbourg.

10. Dispute

In the case of dispute, all claims should be made to the after-sales department at Boulevard des Productions ZAMPOWER, 2 chemin Goeb 67000 Strasbourg..

11 After sales service - Warranty.

We are in charge of all after-sales services. The warranty comes in effect at the date of invoicing. The warranty is specified in the warranty document shipped with the product.

12. Respect of privacy.

ZAMPOWER respects your privacy. In compliance with the law n°78-17 of January 6th 1978 regarding computer databases, files and personnal freedom, you have a right of opposition ( art.26 ), a right of access ( art.34 to  38 ) and a right of rectification ( art36 ) of your personnal data. Thus, you may demand that your personal data which you deem untrue, incomplete, misleading or obsolete, be completed, supplemented , updated or erased if their collection, use or communication is prohibited.

ZAMPOWER
